Board of Zoning Appeals
The Board of Zoning Approval is responsible for the review of applications to the Town for variances to the building and/or zoning code within the Town and the area within two miles of the city limits. The Building Commissioner schedules meetings and presents the relevant information to the Board. The Board must address the following questions/concerns about the variance request: the approval will not be injurious to the public health, safety, morals, and general welfare of the community, the use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner, the strict application of the terms of the zoning ordinance will result in practical difficulties in the use of the property.
The five members of the Board of Zoning Appeals is made up of the following:
- 2 citizens appointed by the President of the Town Council,
- 1 member from the Plan Commission,
- 1 citizen appointed by the Town Council,
- 1 citizen appointed by the Plan Commission (must reside in two mile fringe).
Two of the five members of the Board of Zoning Appeals must reside in the two mile fringe.
The Board of Zoning Appeals meets on an as needed basis.
